Created in 2019, NACON is a pure player in the video game industry. The brand's goal is to offer players an optimal 360° gaming experience.

Nacon positions itself as a designer, manufacturer, and distributor of Premium Gaming Accessories, offering a range of gaming accessories tailored to the desires of all players, whether they are amateurs or professionals (hereinafter the "Accessory(ies)").

The Extended Producer Responsibility channels, Nacon's unique identifiers for Accessories are referenced by ADEME under the following channels:

In a continuous effort to improve gaming comfort, the brand provides its community with the MyNacon service, which allows players to enjoy numerous features such as creating controller profiles and accessing product support.

Who can create a MyNacon account?

Any adult according to the regulations in force in their country of residence can have a MyNacon account. However, any minor can only create a MyNacon account under the dual condition: that they have the minimum legal age required by the regulations in force in their country of residence and that the creation of their MyNacon account is done necessarily with the consent of one of their parents or their legal guardian (Representative) who can assist in creating it.

If you are over 18, you can create your own account and, if applicable, an account for each of your children for whom you are the Representative.

Who can use MyNacon?

MyNacon is intended for anyone aged over 7 years, without any distinction of attribute(s) that can be used to categorize others or divide communities.

It is only from the age of 7 that you can use MyNacon.

If you are between 7 and 17 years old, you can read these Terms of Use and have one of your Representatives explain what you do not understand. However, only one of your Representatives is authorized to read and accept these Terms of Use for you.

Thus, any person providing their personal information acknowledges meeting the eligibility conditions set forth to create and use MyNacon in accordance with the terms, conditions, obligations, representations, and warranties defined by these Terms of Use.

What is MyNacon?

MyNacon is a platform of services accessible via the Internet

The MyNacon services are exclusively for personal use and cannot be used for commercial purposes.

What are MyNacon services:

Offline, the MyNacon platform allows you to access support services:
- each product sheet
- contact our team if you need information

MyNacon also allows you to benefit from a wide range of services made available to you after the creation of a MyNacon personal account.

Logged in with a user account:

The creation as well as the use of a MyNacon account are free of charge.

The creation of a MyNacon account allows the use of the features offered by the platform (the MyNacon Services) described in these Terms of Use.

The creation of a MyNacon account can be completed by filling in all mandatory fields of the account creation form on the MyNacon platform or by using information from a Facebook® account.

You can use Facebook Connect to link MyNacon services to Facebook by using your Facebook username and password in order to facilitate the creation of the MyNacon account by importing your personal data. In this case, your use of Facebook is governed by Facebook’s Terms of Use and Facebook may be considered a third-party service to MyNacon.

Once enrolled and logged in to the MyNacon interface, you have access to MyNacon Services via a personalized dedicated space where you can manage:

Enter and update the information associated with your personal account

- password
- newsletter subscription
- associated accounts
- shipping and billing address(es)

Track your past orders on the site www.nacongaming.com if they were placed with your MyNacon credentials or if they have been manually linked to your account after confirming your purchase by providing the number of said order.

Register Nacon products that you own regardless of the point of sale where you made the purchase. Registration allows you to quickly access product support where you will find the documentation and available software for all our references available online.

Your Profiles :

Have access to a library of profiles made available by members of the MyNacon community. These profiles are downloadable by any logged-in person.

Submit controller profiles. The creation of a profile includes the following 4 sections which must be filled in as follows:

Importing the profile file

Save your preferred profiles.

The publication of profiles is subject to approval by a moderator to ensure that it complies with the « Code of Conduct » MyNacon

Your evaluations of competing profiles

Vote for the profiles posted online according to your judgment and experience.

The MyNacon Services are intended to evolve over time in order to offer you even more features and amenities. We will keep you regularly informed of the changes brought to MyNacon through our newsletters and the updates you will receive.

Your MyNacon credentials will soon serve as a login for certain Nacon games and applications. The associated services will be explained once they become operational and accessible.

What are your commitments ?

By using any of the MyNacon services, you accept these Terms of Use.

You agree that we may apply these Terms of Use to you for all MyNacon services.

By registering for the MyNacon services, using them, or viewing them, you acknowledge that you have read, understood, and agreed to be bound by these terms and conditions.

If you do not accept these terms of use, please cease using MyNacon services with the exception of MyNacon product support services.

You must be honest with us, which involves from you:
- The communication of sincere and truthful information (e.g., age, country of residence...)
- Compliance with PEGI recommendations and other equivalent warnings.

Age Classification

When a video game indicates an age limit, it contains content that is inappropriate for a younger user. If you are Representatives, please visit https://pegi.info/fr for more information on how to block games rated above a certain age limit.

If you, or the account holder for whom you are responsible, are below the age limit indicated on a specific software, you or that holder may not be authorized to view, purchase, or use that game software. Regarding game software, we may prevent you or the account holder from using the online modes of this game.

The information you provide to MyNacon when creating your account and at any other time must be accurate, complete, and up to date.

It is important because we rely on the information you provide us.

We send important information to the email address you provide us.

We use the date of birth to offer you a tailored experience. Depending on age, interests, nature of purchases, location, registration duration...

You accept that we may access your account, retain and disclose your account information if the law requires it or if such access is reasonably necessary to ensure :

The compliance of this information with legal procedures,
The application of these Terms of Use,
An appropriate response to your MyNacon service requests,
The protection of the rights or safety of MyNacon, its users, and the public.

You are responsible for maintaining the confidentiality of certain information

At the time of your registration, you will be asked to choose a username and a password, which must remain confidential. We recommend selecting a password that is as complex as possible.
You are solely responsible for maintaining the confidentiality of your account password, as well as for restricting access to your computer, and you agree to assume responsibility for any activity related to your account. Therefore, Nacon cannot be held responsible if you disclose your password to a third party.

No person from the MyNacon support service will ask for your password by email, phone, or other means of communication

Our Recommendations

Log out of your account at the end of each session.

Set a password to prevent anyone with access to your Authorized System from logging into your account.

Choose a complex password different from those you use for other Internet services, ideally containing letters, numbers, and special characters.

Never share your account information,

Never let another person use your account,

Regularly change your password to prevent any account hijacking and, at a minimum, if you think someone else knows it,

If you have reason to believe that your account is no longer secure (for example, following the loss, theft, or disclosure or unauthorized use of your username or password), you must immediately notify MyNacon via the dedicated contact form : https://my.nacongaming.com/contact

You may be held liable for any loss incurred by MyNacon or by others due to the unauthorized use of your account.

You agree to use MyNacon by accepting these Terms of Use to :

Do not use the MyNacon services for illegal or prohibited purposes by these Terms of Use.

Do not use, reproduce, modify, publish, transfer, distribute or sell for commercial purposes any or all of the information and services obtained from the MyNacon services.

Do not use the MyNacon services in a manner that could damage, disable, overload, or deteriorate the MyNacon services, or interfere with the use and/or enjoyment by any other party of the MyNacon services.

Do not obtain or seek to obtain data and/or information by means not provided by the MyNacon platform.

Respect the use of MyNacon communication services

You acknowledge using the communication services only to post messages and data that are appropriate and related to this particular communication service and, in particular, never to:

Defame, mistreat, harass, stalk, threaten, or violate the legal rights of others,

Publish, download, distribute, or disseminate inappropriate, rude, defamatory, infringing, obscene, indecent, or illegal names, data, or information,

Upload files containing viruses, corrupted elements, or any similar software or programs that could damage the operation of another's computer,

Impersonating another person,

Prevent or restrict any other user from enjoying the MyNacon services,

Violate the rules of the Code of Conduct or the rules that may apply to any MyNacon service,

Collect information about others, including email addresses, without their consent,

Violate any law or regulation in effect.

We reserve the right to review any data published on MyNacon and to remove it at our sole discretion. We reserve the right to terminate your access to all or part of the communication services in the event of a violation of the terms of use of MyNacon services or more broadly of these Terms of Use.

We reserve the right to disclose any information at any time in accordance with laws, regulations, or requests from public authorities, or to correct, refuse to publish, or remove any data or information, in whole or in part, at our sole discretion.

What are the consequences of non-compliance with the Terms of Use?

We may in particular suspend your MyNacon account and the use of services attached to it.

What are our commitments ?

We wish for all members of the MyNacon platform to make the most of the services we offer them, although we cannot guarantee that everyone will exhibit good conduct. Therefore, we cannot be held responsible for the activity and content of each MyNacon member.

Our main goal is to enable you to use MyNacon in a permanent and continuous manner while offering you services of interest that are likely to meet your expectations as consumers and users of the MyNacon platform. We are committed to improving MyNacon services over time to provide each MyNacon member with a better use of these services.

Changes can be made in several ways. We will provide you with explanations on these updates.

The services made available to you:

We adopt appropriate technical measures to ensure the security of https://my.nacongaming.com/ and the information we hold about you in order to prevent unauthorized access to your MyNacon account.

Our monitoring of your online activity is limited and is conducted mainly through moderators.

It is thus possible that we may remove user-generated content that would violate these Terms of Use without prior notice from us. Other users can record events they witness and transmit them to us.

The information we obtain may include your content, textual communications, the schedules and locations of your activities, your real name, your IP address.

We use this information to establish these Terms of Use, to comply with the law, to protect our rights, those of licensors, those of our users, and to protect the community of MyNacon members. This information may be shared with competent Public Authorities.

In such situations, we reserve the right to terminate at our discretion your access to all or part of the MyNacon services and related services or any of their parts, at any time, and without prior notice.

RIGHT OF WITHDRAWAL

1. Scope of Application

The right of withdrawal provided for by article L221-18 of the Consumer Code applies to all products sold on our site, with the exception of digital video games due to their digital nature and their immediate execution after purchase.

2. Cooling-off Period

The withdrawal period is 14 (fourteen) full days starting from the day after the delivery date of your order. In the case of an order for multiple Products, the fourteen-day withdrawal period begins the day after the receipt of the last Product (the postmark serves as proof of the sending date). When the fourteen-day (14) period expires on a Saturday, a Sunday, or a public holiday or non-working day, it is extended to the next business day.

To withdraw, you can :

Download the standard withdrawal form (reproduced in Appendix 2 below) available on MyNacon, print it, fill it out, and send it to the mailing address listed on the said form.
Send us in writing by any other means your clear declaration expressing your intention to withdraw.

In all cases, the withdrawal document must include at a minimum your first and last names, as well as your order date and number.

You must return the product(s)/service(s) that are the subject of the withdrawal to Nacon, without undue delay and, in any event, no later than 14 (fourteen) days following the date of communication of your decision to withdraw.

You may request the refund of the ordered product(s)/service(s) at the address provided by Nacon or at 09 69 37 03 08 (cost of a local call from a landline)

The return of the product(s)/service(s) is under your responsibility and at your expense. Any damage suffered by the Accessory on this occasion is likely to defeat the exercise of your right of withdrawal. We recommend opting for a tracked shipment or taking out insurance for the transport of the returned Accessory/Accessories.

The return of the Accessory(ies) must be done in their original packaging, in good condition, with all potential accessories and documentation. The Accessory(ies) must be in perfect resalable condition. Thus, any incomplete or damaged Accessory resulting from handling other than that necessary to establish its nature, characteristics, and/or proper functioning will not be reimbursed.

Any order returned incomplete to the indicated address and/or in the absence of the return number of the Accessory(ies) and/or the return of the Accessory(ies) to a different address than the one communicated by Nacon will not be processed as a return and, therefore, will not be refunded.

You will be refunded within 14 (fourteen) working days following the date on which you exercised your right of withdrawal. Nevertheless, Nacon may defer the refund until the actual receipt of the products or until you have provided proof of shipment of the products, whichever is the earlier.

It is specified that a product/service that has benefited from a promotional advantage will be refunded at the price you actually paid or should have paid if it no longer meets the conditions to benefit. In other words, the refund will be based on the price of your order invoiced and collected by Nacon.

Nacon will fully reimburse you, including any potential delivery charges (that is, the price of the items paid and received by Nacon as well as the initial shipping costs up to the standard delivery rate offered by Nacon, and except for additional costs resulting from the fact that you have chosen, if applicable, a more expensive delivery method than the standard delivery method offered on MyNacon), except if the withdrawal concerns only part of the order, in which case the delivery charges will remain your responsibility.

Nacon will reimburse you using the method of payment used to pay for your initial order, except with your express agreement to use another method of payment.

What are the warranties on the ordered products?

You benefit from applicable legal guarantees, guaranteeing the defects of conformity of a product/service sold under the conditions of Articles L.211-4 and following of the Consumer Code, and the hidden defects of the sold item under the conditions provided for in Articles 1641 and following of the Civil Code. The details of these guarantees are listed in Appendix 1.

If you notice a defect in your product/service, you must contact us at the following number: 09 69 37 03 08 (cost of a local call from a landline). We will perform an online pre-diagnostic. If the noted non-conformity appears to be a defect covered by the warranty, we will proceed with the exchange of your product/service.

To do this, you must, if applicable, return the products in question to Nacon, using the prepaid label that has been sent to you for this purpose, stating the non-compliance or the hidden defect.

Upon receipt of your Accessory, a diagnostic of your Accessory will be conducted by our advisors. If it is confirmed that the defect is covered by the aforementioned warranties, we will send you a new Accessory to your home in mainland France within a maximum period of 30 days, or, in case replacement is not possible within this period, Nacon will refund you up to the purchase price of the concerned product.

You are also informed that you may be entitled to a reduction of the price of the defective product or termination of the contract in the cases provided for in Article L.217-14 of the Consumer Code.

We commit ourselves to returning you an identical or superior quality Accessory.

If it turns out, after diagnosis, that the defect is not covered by the aforementioned guarantees, we will return your original Accessory.

In all cases, it is your responsibility to retain the proof of purchase in order to be able to avail of the warranty.

It is recalled that within the framework of the legal guarantee of conformity, the consumer:

has a period of two years from the delivery of the goods to act against the seller;
may choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L. 217-9 of the Consumer Code;
is exempt from providing proof of the existence of the lack of conformity of the goods during the 24 months following the delivery of the goods.

It is recalled that the consumer can decide to enforce the warranty against hidden defects of the sold item as per Article 1641 of the Civil Code, and in this case, they can choose between the rescission of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.

Do we sometimes modify these Terms of Use?

Yes, we may make changes to these Terms of Use.

We may occasionally perform an update of the MyNacon services, which may include the addition or deletion of features, taking into account both your interests and ours, with the aim of improving your experience on MyNacon.

If the changes are significant or detrimental to you, we will ask you to accept these new Terms of Use before logging in to MyNacon again.

If a child in the family under the age of 18 is the user of MyNacon, one of their Representatives must accept them before they can log in again in their turn.

If the changes are minor, we will inform you of the changes within a reasonable time, for example, with a message on MyNacon which will appear when logging into MyNacon or by email. If you or children in the family under 18 years old continue to use MyNacon after being informed of the changes, these will be considered accepted.

You will not be able to continue to use MyNacon until you have accepted all the significant or detrimental changes; if you decide not to accept these changes, please contact us to close your account.

Who can enforce these Terms of Use?

These Terms of Use do not create any rights enforceable by a third party.

We may transfer our rights and obligations under these Terms of Use and any contract made between you and us under these Terms of Use without your consent. If you are not satisfied with such a transfer, you may choose to close your account in accordance with the provisions of these Terms of Use. You may not transfer your rights and obligations under these Terms of Use.

You cannot transfer your rights and obligations under these Terms of Use.

Specific conditions for certain MyNacon Services.

The MyNacon Services that we offer can operate globally.

All MyNacon Services are exclusively reserved for domestic and non-commercial use.

Content created and shared online

Certain MyNacon services allow you to share the Profile(s) published by you on the MyNacon platform with us and other members.

You are the owners of the Profiles you publish, but you cannot use them for commercial purposes.

When you share a Profile:

We publish it on MyNacon after validation via our moderation service, which can modify the Profile in question for various reasons and, in particular, modify or delete the Profile if necessary, to comply with the law or exercise our rights as outlined in these Terms of Use.

Other people can interact with each of your published Profiles and perform various appreciation actions such as: like/dislike/add as favorite.

The data that you provide us published on MyNacon

We do not claim ownership of the images, texts, or other data (Contribution(s)) that you provide on MyNacon or that you post, upload to the extent that the content you post does not include data that was provided to you or is owned by MyNacon.

Nonetheless, by publishing, uploading, submitting, or sending your Contributions, you grant Nacon, its affiliates, or its sublicensees the irrevocable, non-exclusive, royalty-free, sublicensable, and transferable authorization to reproduce, distribute, create derivative works from, display, or use your Contributions in connection with the MyNacon services or the commercial activities of Nacon (and its successors and affiliates), including but not limited to the distribution of your Contribution in any current and future media in which the MyNacon services may be distributed or transmitted now or hereafter, and to publish your name in connection with your Contribution. This authorization shall survive any expiration or termination of these Terms of Use.

No financial compensation will be offered for the use of your Contribution. We have no obligation to publish or use any Contribution you may provide and reserves the right to delete your Contribution at any time.

How your account can be suspended or terminated:

You can close your account by contacting us via the dedicated form https://my.nacongaming.com/contact or directly on the MyNacon platform from your personal account.

We may suspend or close your account in the event of non-compliance with these Terms of Use or if you have not used it in the past sixty (60) months. We will only proceed with this suspension or closure if the applicable laws in your country allow it.

Once your account is closed or terminated, you will no longer be able to access MyNacon or use the services related to this account. You unconditionally waive any content provided on MyNacon that may remain on this platform.

Ownership and Use of Intellectual Property Rights

MyNacon, Nacon are trademarks or registered trademarks of Nacon. The company names and their products used on MyNacon may be trademarks registered by their respective owners.

Applicable law, jurisdiction

The present MyNacon Terms of Use have been written in French and, in the event that there is any disparity between the French version of these Terms of Use and the translation thereof, the French version shall prevail over it.

As a consumer, you may have rights under local laws in force that cannot be excluded, limited, or modified in any way. These rights take precedence over these Terms of Use.

These Terms of Use are subject to French law.

Any dispute relating to the formation, interpretation, execution, or termination of these Terms of Use, including in cases of emergency, multiple defendants, or third-party proceedings, will be subject to the exclusive jurisdiction of the courts of Paris.

In the event of a dispute between the professional and the consumer, they will strive to find an amicable solution.

In the absence of an amicable agreement, the consumer has the possibility of contacting the consumer ombudsman free of charge, which is the European Mediators Association (AME CONSO), within a period of one year from the written complaint addressed to the professional.

The referral to the consumer mediator must be carried out:

either by completing the form provided for this purpose on the AME CONSO website: www.mediationconso-ame.com;
or by mail addressed to AME CONSO, 197 Boulevard Saint-Germain - 75007 PARIS.

In the absence of an agreement through the mediator, the consumer may bring the matter to the competent court.

Annex 1

Articles related to the legal guarantee and the warranty against hidden defects

Full text of relevant articles from the Consumer Code and the Civil Code regarding the legal guarantees for which the seller of a good is responsible:

Article L217-4 of the Consumer Code:

The goods are in conformity with the contract if they meet, in particular, where applicable, the following criteria:

1° It conforms to the description, the type, the quantity, and the quality, including with regard to functionality, compatibility, interoperability, or any other characteristic set forth in the contract;

2° It is suitable for any special use sought by the consumer, brought to the attention of the seller at the latest at the time of the conclusion of the contract, and which the latter has accepted;

It is delivered with all accessories and installation instructions, which must be provided in accordance with the contract;

4° It is updated in accordance with the contract.

Article L217-5 of the Consumer Code :

I.- In addition to the contract conformity criteria, the good is compliant if it meets the following criteria:

1° It is suitable for the customary use expected of goods of the same type, taking into account, where appropriate, any provision of European Union law and national law as well as all technical standards or, in the absence of such technical standards, specific codes of conduct applicable to the relevant sector;

2° If applicable, it possesses the qualities that the seller has presented to the consumer in the form of a sample or model, before the conclusion of the contract;

3° If applicable, the digital elements it comprises are supplied according to the most recent version available at the time of the contract conclusion, unless the parties agree otherwise;

4° Where applicable, it is delivered with all accessories, including packaging, and the installation instructions that the consumer can legitimately expect;

5° If applicable, it is provided with the updates that the consumer can legitimately expect, in accordance with the provisions of Article L. 217-19;

6° It corresponds to the quantity, quality, and other characteristics, including in terms of durability, functionality, compatibility, and safety, that the consumer can legitimately expect for goods of the same type, considering the nature of the goods as well as public statements made by the seller, any person upstream in the chain of transactions, or a person acting on their behalf, including in advertising or on labeling.

II.- However, the seller is not bound by all public statements mentioned in the preceding paragraph if he demonstrates:

1° That he did not know them and was legitimately not in a position to know them;

2° That at the time of the conclusion of the contract, the public statements had been rectified under conditions comparable to the initial statements; or

3° That public statements could not have had any influence on the purchase decision.

III.- The consumer cannot dispute the conformity by invoking a defect concerning one or more particular characteristics of the good, of which he was specifically informed that they deviated from the criteria of conformity stated in this article, a deviation to which he expressly and separately consented at the conclusion of the contract.

Article L217-12 of the Consumer Code:

The seller may not proceed according to the choice made by the consumer if the requested compliance is impossible or entails disproportionate costs with regard notably:

1° Of the value that the good would have in the absence of non-conformity;

2° Of the importance of the lack of conformity; and

Of the potential possibility to opt for the other choice without major inconvenience for the consumer.

The seller may refuse to bring the goods into compliance if it is impossible or results in disproportionate costs, particularly with regard to 1° and 2°.

When these conditions are not met, the consumer may, after a formal notice, seek specific performance of the solution initially requested, in accordance with articles 1221 and following of the civil code.

Any refusal by the seller to proceed according to the consumer's choice or to bring the good into conformity must be justified in writing or on a durable medium.

Article L217-16 of the Consumer Code :

In the cases provided for in Article L. 217-14, the consumer informs the seller of his/her decision to terminate the contract. He/She returns the goods to the seller at the latter's expense. The seller refunds the consumer the paid price and returns any other advantage received under the contract.

If the lack of conformity concerns only some goods delivered under the sales contract, the consumer has the right to the termination of the contract for all the goods, even those not covered by this chapter, if it cannot reasonably be expected of them to accept keeping only the conforming goods.

For the contracts referred to in Section II of Article L. 217-1, providing for the sale of goods and, incidentally, the provision of services not covered by this chapter, the consumer has the right to terminate the entire contract. In addition, in the case of a bundled offer within the meaning of Article L. 224-42-2, the consumer has the right to terminate all related contracts.

The respective obligations of the parties to the contract, mentioned in Article L. 224-25-22 and related to the consequences of the termination for digital content and digital services, are applicable to the termination of the sales contract of a good containing digital elements.

Article 1641 of the Civil Code:

The seller is bound by the warranty for latent defects of the sold item that render it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would have given a lesser price for it, if they had known of them.

Article 1648, paragraph 1, of the Civil Code :

The action resulting from redhibitory defects must be initiated by the purchaser within a period of two years from the discovery of the defect.
